Muscat: His Majesty Sultan Haitham bin Tarik today issued Royal Decree, No. (35/2025), establishing the Investment and Trade Court and promulgating its law.
The decree reads as follows:
Article (1) states that a court to be named the “Investment and Trade Court” shall be established and affiliated to the Supreme Judiciary Council. It stipulates that the new court’s headquarters shall be in the Governorate of Muscat and the provisions of the law attached to this decree shall be applied to the same court.
Article (2) states that courts shall continue to adjudicate lawsuits, orders and requests that, pursuant to the attached law, have become subject to the jurisdiction of the Investment and Trade Court, provided that the lawsuits, orders and requests had been filed prior to the date of enforcing provisions of the attached law.
Article (3) states that the Deputy Chairman of the Supreme Judiciary Council shall issue a decision regulating the functions of the Investment and Trade Court and its administrative divisions.
Article (4) annuls all that contradicts the attached law or contravenes its provisions.
Article (5) says that this decree shall be published in the Official Gazette and shall be enforced from 1 October 2025.
